You should get your EAD after FP
Not true... FP depends on your local office... If they are backlogged then your FP is delayed.. So if you are from BA/NY/NJ your FP will be delayed... As far as EAD is concerned you just have to wait... Its very unpredicatible... I got my EAD 1 month AFTER I got my gc! go figure!! My wife received hers last week.. BTW I am a early June filer

I have applied for H1B transfer and here is my situation.
H1B expiration date with ex employer was 06/10/2010 and I transferred the H1B to a new employer on 06/01/2010 and the approval came on 08/09/2010. However the approval notice says the validity date is from 08/02/2010 to 08/01/2011. It should have been 06/11/2010 because we filed this transfer before the expiration date.
We sent an inquiry but the officer was saying the application was submitted based on new employment and not continuation of previously approved employment without change with the same employer, so we will not change our decision.
What should I do? I think I was out of status from 06/11 to 08/01. Does anyone have any information?

If your stay is less than 1 year abroad, you can reenter using just your green card. If you want to stay 1-2 years outside the U.S, you will have to apply for a reentry permit before departure. But, it will be considered as a break (i.e, more than 1 year abroad) in the continous residence requirement of 5 years when it comes to your naturalization application.
If you want to stay longer than that, you will have to apply for "returning resident permit" for which you need to prove that your intent is to be a permanent resident but, your stay abroad longer than the period of the reentry permit was beyond your control.
Please consult an attorney so that you don't lose your PR.

You can take time off -- like 4 weeks without any issue (I have done this), as long as the new company has filed to transfer your H1B petition.
I guess you should avoid going out of status -- where the old company has revoked your H1B when the new company hasn't even filed the H1B transfer petition. Other than this, taking time off between jobs should not be any problem at all, provided you stay within the country and, no travel outside the US. But if you do, you should consult your lawyer about its implications. Good luck with your new endeavors.

If I remember correctly, if your I-140 is "approved" and if your I-485 is pending for more than 180 days, then it "should not" be matter whether your I-140 is revoked or not.
In your case, if you get RFE (what for????) , just send the AC21 letter and you will be fine.

Because the CNMI will become part of the "United States" as defined by �101(a)(38) of the INA, "residence or presence in the CNMI before 28 November 2009 shall NOT be considered residence or physical presence within the USA for INA purposes. Thus, on 29 November 2009, all persons physically present in the CNMI are considered "to be present in the United States without inspection, by operation of law."
Will these PWIs (present without inspection) be eligible to adjust status? Unclear? Are they working "abroad" for purposes of L visas? Yes, as it turns out. One thing is clear: Legal Permanent Residents (so-called "green" card holders) who wish to base a naturalization application based on physical presence in the CNMI will NOT be able to do so for pre-29 November 2009 periods of time. Hi,
My wife has FP appointment scheduled for 12/29/07, She is in india now. I have returned from india today only(12/28) and saw the FP appointment. Can i reschedule FP one day before the appointment date? If i send the reschedule request today will USCIS accept it? since there is only one day left. Please advice me.

On 11/27 last month you said that you had received your FP appointment notice and you want to reschedule it . Did you not do it at that time ? Is this the second time you want to reschedule.
The procedure is the same as explained in your first post and yes you can reschedule it one day before it is due ( but I would strongly advise against it if this is the second time you want to reschedule ).
But I guess since your wife is in India you have no choice. Consult your lawyer also in this case so as to keep him in the loop and get his advise also.

Based on your approved I-140 if you are eligible to file 485 or get EAD then he can also get EAD.
But using only approved I-140 , then only the beneficiary can get extended.

I am applying for a green card and my lawyer sent me a case number starting with an A and in the format : A-#####-##### for my PERM.
I tried http://pds.pbls.doleta.gov/ but it does not accept case numbers starting with "A".
Can you please tell me where I can go to look at the status of this application?

Hi Buddy,
Put your address in 485 apps. You may at some point want to change the employer under AC21 rule and this will allow you to 'carry' the 485 process with you. Basically you own 485 process whereas it's not the case with labor and I-140.

I have a Q regarding the follow-to-join rule. Say one has filed I-140 and I-485 recently (concurrently filing). To use the follow-to-join rule, can the spouse file I-485 at any time after the primary applicant's I-140 is approved but before I-485 is approved? In that case, will the spouse's I-485 be approved around the same time as the primary applicant?
A related Q, will a Visa number be immediately available after one's I-140 is approved?
