My wife has H4 stamped and valid till Nov 2008 but from Oct 2007 she changed her status to H1B. She has I797. My question is when she goes to India does she need to stamp H1 B or she can reenter on already stamped H4 ?

I have a original copy whereas the lawyer has the approved I140.
Should I ask for the original or is that copy good enough?

Hi Gurus,
My PD is 04/2002 and RD is 18/June/2007, EB3 India. EAD approved and fp done in Aug.
There are no soft LUDs on my 485 after 7/17/2007. What does this mean? Is there a way to check if I am stuck in name check?
I see many people with later RD and PD getting soft LUDs. Is anyone else in the same boat? Please advice..
thanks
-badal
So now we are tracking Soft LUDs as well :)
Not getting a soft LUD is the norm. It just means your case was not an exception and you can't expect any miracles ..Yet! But Getting LUDs is not guaranteed to result in GC approval either. So please stop worrying about every little thing and enjoy your life... (Like I'm doing visiting this forum every now and then ;)

He can have both types of permanent residence pending at the same time - marriage-based and employment-based. This is very common. The marriage-based filing will probably be approved sooner than the other, because priority dates are so backlogged now.
That is wonderful news, Elaine, thanks so much for the fast reply! We are actually in the DFW area, so if we need a lawyer for this 2nd application, I'll remember your name!

Immigration law is federal law. You can work with a good attorney anywhere in the country via fax, phone and email.
Hi Everybody,
Could you please recommend a competent and an experienced immigration attorney in the Central NJ area?
I will be grateful to you for any help from you on this matter.
Regards.

Murdoch and Speyer on what they would do if they were President Obama:- Murdoch: "I would establish my authority. And I would certainly seek actively to have more influence in Congress."
- Murdoch: It's irresponsible of President Obama ("I shouldn't say corrupt") to seemingly stand aloof on various important issues while focusing only on a select few.
- Murdoch: "I think there can be much better initiatives coming from the government." The health debate is "a fiction," will cost a fortune and will not improve the health industry.
- Speyer: "If you run a business, you have to be a leader; demonstrate you are in charge. The President is a very smart man; the problem is he hasn't exercised leadership."
- Speyer: "I don't believe we're running efficiently." Instead of raising taxes, he said he would reduce them and also cut government spending, which has "gotten out of control."
Speyer and Murdoch on immigration and education:
- Speyer: One of the biggest challenges we will face after the recession is human resources. Despite today's unemployment, we are going to need people.
- Murdoch: "We have a crazy immigration system. It's an absolute scandal and it must be tackled by the administration quickly." We educate people and afterward we refuse to give brilliant minds a green card; we are losing talent.

I came to the US on F1 for MS and then trasferred to another college to pursue my PhD. During this time my F1 visa expired, but I am maintaining my legal status as my I-20 is valid. I got married last year and my wife who originally came on F1, is now on H1.
I am going to planning to go to India in end of April and need to renew my F1 visa. What are the chances of my renewal getting refused, due to my wife's H1 (dual intention) status? What documents if any, can I show in order to prove that I have intentions to come back to the US?
I need to get a visa interview date soon, so please reply as soon as is convenient.
Thanks in advance!

Hi Friends,
I work for Company A from the year 2003 on H1-B Visa and here is my details
Priority Date : Aug 2004 (EB3-I)
I-140 Approved date : Jan 2007
I-485 Filed date : July 2007
Currently using : H1-B (8 th year running)
EAD & AP : I have both EAD & AP but not using it at this stage.
Now i got an offer from Company B but they can accept only EAD or GC with Good salary and position. I am really tired of getting low salary with company A as they started taking advantage of me.
Now if i use EAD card to move to company B (by using AC21) and once i get a green card (don't know when ??) do i have to come back to company A and work for one or two years as GC is for future employment ? Is there any rule like this ?
I am also planning to have my personal attorney after moving to Company B to take care of AC 21 and other communications.
I am not sure Company A will allow me to move at this stage and i cannot waste my life with this company for a low salary so i want to move and make some progress in my life.
Have any of you moved like this and got GC ? Will there be any issues ?
Please advise.

IVC needs a member to speak with a reporter. This is for a highly recognized publication in the U.S., but the member must meet the following requirements:
1) The individual must be EB1 or O category; and
2) The individual must have correspondence from the US government documenting the absurd red tape (a letter explaining the delays in their green card, etc).
Please contact us as soon as possible if you meet these requirements or know someone else who is - and are willing to speak with the reporter. It would greatly advance IVs cause to be included in such an article, so please help us.

Hi all!
I've been trying to get a job offer from Canada for the past one year as my occupation is not on the list of occupations that have shortage. I'm a market research analyst and work online with a UK company for almost 3 years. I would love to move to Canada and have a real job and family but am at a stage where I do not know what else to do as the companies want you to be present in Canada and Canadian govt asks for a job offer to get a visa?
Very confused here. If someone got an arranged offer from Canada could you please guide on how much work experience you had and how you got an offer?
Thanks!

My H1B 6th Year expires August 2007 and need to apply for 7th year extension.
The below are options I read in murthy.com
1. Labor pending or approved before 365 days of H1B 6th Year expires
2. I140 Approved
Applied for PERM labor in April 2007 and still in pending status (First option ruled out)
After looking at July 2007 Visa Bulletin immediately Applied for I140 using Substitution Labor . Assuming that I can work on EAD.
And because of Revised Visa Bulletin I could not apply for I485.
Can I apply for 7th year extension based on I140 receipt (using Labor substitution)?
If no to the above question and suppose if my PERM labor is approved some time in July and if the USCIS start again the Premium for I140 Can I apply for another I140 from same employer?
Please reply ASAP,
Thanks

Other gurus can answer in a detailed manner. I am going to very short. Chinese Eb3 have filed for an injunction stating that they need to be allocated visa numbers because in 2008 and 2009 they were overlooked because DOS could not count the inventory of EB3 properly.
DOS replied that this kind of injunction would harm other countries ppl. DOS is allowed by law to make reasonable estimates in progressing and degressing priority dates. If some ppl are left behind they cannot do anything.
Here is the part of the law which states that DOS has the authority to do reasonable estimates of priority dates and this is what was stated in the DOS response to the injunction
Congress has expressly
provided that in allocating visa numbers, the Department of State may “make reasonable
estimates.” 8 U.S.C. 1153(g). In relevant part, Section 1153(g) states:
For purposes of carrying out the Secretary’s responsibilities in the orderly administration
of this section, the Secretary may make reasonable estimates of the anticipated number of
visas to be issued during any quarter of any fiscal year . . . and to rely upon such estimates
in authorizing the issuances of visas.

so why are ppl stuck for 2 to 4 years in security chks ?
I hope he is not referring to the EAD as that is considered an immigration benefit.
